Terms of Service

1. Parties & Definitions

This agreement is entered into between COSMOS AI ("Company", "We"), operator of the COSMOS AI platform ("Platform", "Service"), and any natural or legal person who registers for an account ("User", "You"). By signing up you confirm that you have read and accepted all terms below.

2. Description of Service

COSMOS AI is a cloud-based SaaS platform offering AI-powered logistics management, CRM, productivity tools, analytics, and marketing services. All modules, APIs, and integrations within the Platform are covered by this agreement.

3. Account Registration & Security

• A valid email address and accurate identity information are required.
• You are solely responsible for the security of your account credentials.
• You are responsible for all activities performed through your account.
• You must notify us immediately of any unauthorized access.

4. Acceptable Use

You agree to use the Platform in accordance with the following rules:

• Do not use the Platform for any unlawful purpose.
• Do not infringe third-party rights.
• Do not perform actions that compromise the security of the Platform.
• Do not reverse engineer, extract source code, or abuse the APIs.
• Do not overload the system with automated bots.

5. Limitation of Liability & Disclaimer of Warranty

• The Platform is provided on an "as-is" basis. No express or implied warranty is provided.
• AI-based suggestions, predictions, and analyses are informational only and are not guaranteed to be accurate.
• COSMOS AI is not liable for any direct, indirect, special, incidental, or punitive damages arising from use of the Platform.
• We are not responsible for damages resulting from technical disruptions, server outages, data loss, or software bugs.
• Our control over third-party integrations (APIs, webhooks, external services) is limited; we are not liable for issues arising from them.
• The Platform is not warranted to operate uninterrupted or error-free.
• In any event, COSMOS AI's total liability shall not exceed the service fees paid by the User during the preceding 12 months.

6. Data Collection & Processing

By using the Platform you consent to the data collection and processing activities described below. For full details see our Privacy & Data Policy.

• Identity and contact information (name, email, phone).
• Platform usage data, logs, and analytics.
• Anonymized usage patterns for AI model improvement.
• Your business data (CRM records, logistics data, analytics reports).

7. Data Sharing

Collected data may be shared with third parties in the following cases:

• Where required by law or authorities.
• With service providers and business partners for data processing.
• Anonymized and de-identified data for AI model training.
• With security partners to protect platform integrity.
• In case of merger, acquisition, or asset sale.

8. Intellectual Property

The Platform, its design, source code, algorithms, AI models, and all related intellectual property rights belong to COSMOS AI. Rights in content uploaded by the User remain with the User; however, the User grants permission for such content to be processed for the delivery of the Service.

9. Suspension & Termination

• Your account may be suspended, with or without notice, for violations of this agreement.
• You may close your account at any time.
• Your data is deleted within 30 days after account closure.
• Fees already paid are not refundable (except where required by law).

10. Changes to This Agreement

COSMOS AI reserves the right to modify this agreement upon prior notice. Material changes will be announced by email or in-platform notification. Continued use of the Platform after such changes constitutes your acceptance of the new terms.

11. Governing Law & Dispute Resolution

This agreement is governed by the laws of the Republic of Turkey. The courts and enforcement offices of Istanbul shall have exclusive jurisdiction over any disputes.
